BMM6622 - Law in the Business Context

Objectives:

On successful completion of the module, students will be able to:br> explain and critically apply the main principles of business, company and employment laws affecting company directors, entrepreneurs, managers and employers;
critically evaluate the operation of legal frameworks within which organisations operate, including particularly aspects of negligence, nuisance, agency and some criminal issues;
demonstrate advanced skills of critical analysis of the law, including logical application of law to the solution of legal problems likely to encountered by an organisation;
demonstrate an ability to identify and use legal materials, including some primary sources.

Content:

The module provides an opportunity to learn and understand areas of English and EU laws which directly affect the legal structure and operation of business organisations. It examines the nature of the relevant law in context and explores the way in which the law affects directors, entrepreneurs, managers and employees. The key module content examines:
The structure and hierarchy of the English Court system
Sources of law and precedence
Contract law
Tort
Equity and Trusts
Employment law
Consumer law
Legal structure of businesses
Applicable instruments (health and safety; insurance liabilities; pensions law, etc)
Aspects of liability under criminal law.

Learning and Teaching Information:

The sessions will be organised in mainly 3-hour teaching blocks. Lectures will deliver core theoretical frameworks, followed by seminar discussions and workshops, and offer guidance in the selection of appropriate sustainability tools and metrics. Some lectures and workshops will be shared with Level 5 students but separate tutorials will be organised for Level 6 (BA Accounting Top Up) students to prepare them for an appropriate Level 6 examination.
There will be key focus on case studies, problem-identification and problem-solving, using exercises and activities linked to legal issues in finance, management and business contexts. Students will be expected to make full use of case law and current law reports
Formal assessment will evaluate research/information retrieval skills and critical thinking and students will be expected to present their findings and analysis through a range of examination questions.

Marginal condonement of failure is allowed for this module within the degree programme but no marginal condonement of failure is allowed in relation to ACCA exemptions.

Industry guest speakers and visiting experts will contribute to the delivery of this course, particularly in the areas of company/marketing and employment laws.
