BAM6032 - Employment Law

Objectives:

1) explain the principles of English Law which affect the employment relationship, including the framework within which employment law operates and the dynamic nature of employment law;
(2) demonstrate the logical application of the solution of legal problems likely to be encountered in the workplace; (4) conduct research using primary sources as directed, including internet resources;
(5) demonstrate their knowledge and understanding clearly and effectively in written form.

Content:

The module provides an opportunity to learn and gain understanding of English Law affecting employment, including an analysis of the nature of a contract of service and the obligations of employer and employee which arise from it. It examines the relevant law in context and seeks to show the dynamic nature of employment law and its particular susceptibility to social and political pressures and influence of EU law. It explores the practical effects of law in employment situations.

It addresses such topics as the contract of service, statutory rights of employees, discrimination and equal pay in the workplace, remedies, institutions of employment law, including tribunals, ACAS, CAC, and discrimination commissions. Employment rights and duties in respect of termination of employment and redundancy and health and safety at work will be examined.

Learning and Teaching Information:

The module will be delivered by weekly lectures supported by weekly small group sessions in the form of tutorials. In tutorials all students in the group will be expected to discuss questions and solve legal problems, issued in advanced based on common set reading and research into primary sources of law. Some sessions will be operated on the basis of team work. Some tutorials will be operated on a surgery basis for the planning of assignments, feedback and revision.
