On successful completion of the module, students will be able to:
(1) explain and assess the legal framework within which organisations operate, including particularly aspects of negligence, nuisance, agency and some criminal issues;
(2) distinguish between an organisation’s responsibilities in tort, contract and crime;
(3) demonstrate skills of critical analysis of the law including logical application of law to the solution of legal problems likely to be encountered by an organisation;
(4) demonstrate an ability to identify and use legal materials, including some primary sources;
(5) apply their legal knowledge and skills clearly and effectively in written form.
This module provides an opportunity to learn and gain an understanding of how English law impacts on organisations. It examines the legal framework within which all organisations operate and the possible consequences of acting outside the law. It addresses the concepts of tortious and vicarious liability, focussing particularly on the tort of negligence. The module explores the extent to which an organisation has a legal responsibility to visitors, lawful or not. The module examines the principles of nuisance and the implications for organisations.
The potential for criminal proceedings against organisations will also be evaluated.
The key legal features of an agency relationship and the implications for an organisation will be explored.
The module will be delivered by weekly lectures supported by weekly small group sessions in the form of tutorials. In tutorials all students in the group will be expected to discuss questions, including legal problems, issued in advance based on common set reading and some limited research into primary sources of law. Some sessions will be operated on the basis of team work. Three tutorials will be operated on a surgery basis for the planning of assignments and feedback. There will also be a workshop to prepare for the semester two case study.
